Lowell Default

Hi
I stupidly defaulted on an orange account, the default was originally dated january 2012, this debt has now been handed over to Lowell. I haven't paid it yet, I intend on settling it over the next month. On checking my credit rating Lowell have defaulted me in August 2013, how can they do this when the original default was January 2012, I haven't defaulted on anything recently and there is no payment plan in place with them as yet. As I'm aware the original default was 2012.

You would need to write to them and complain about them recording an incorrect default date and that you require them to correct it to the original default date used in accordance with the ICO guidelines on filing defaults.A smile enriches those who receive without making poorer those who giveor "It costs nowt to be nice"0

Looking back through my account there are other defaults from Lowell, you can see one where I set up a payment agreement with them and you can see the balance decreasing over 4 months, yet they continued to default me every month until it was paid off, can they do this? There is also a defaults every month from April to September 2010 on my HSBC account despite it showing a balance if £477, what can I do about this?0

Those monthly default entries are not new defaults, they are just showing the account is still in default. That is correct.
Regarding the HSBC account -is the debt now repaid?

I just don't think Lowells should be able to default someone, the default should be registered with the original provider after 3-6 months, Lowells have no place defaulting someone unless you have not kept to a payment plan, disgraceful!0

When a creditor sells a debt then the debt collector (lowells or others) is allowed to register the default in their name (so that when you make payments towards the debt they are able to update your credit file to mark the balance reducing or mark that it is fully paid).
They are not allowed to change the default date from the original one the creditor used. If they do then you need to complain to get it rectified.A smile enriches those who receive without making poorer those who giveor "It costs nowt to be nice"0
