    To put it bluntly, you have two options:

    1. Get a repair under warranty from the manufacturer.
    This will be all that is provided for under the terms of the warranty, and it is highly unlikely you will get a refund from the manufacturer as you have no right to one at all.

    2. Hold the seller liable under the Sales of Goods Act.
    The seller is liable for faults up to 6 years (put very simply). After 6 months, however, it is up to you as the buyer to prove the fault is inherent. To do this, you would need to pay for an independent engineers report to state this (the cost of which you can claim back from the retailer if the fault is inherent). Once you have proven this, the seller can offer a repair, replacement or partial refund, whichever is least costly to them. I'm almost 100% sure they will offer to repair, and will send it back to the manufacturer on your behalf to get the repair under warranty, so it's probably quicker and easier to go directly there yourself - which will be why they pointed you in that direction. Should the manufacturer not be able to repair, the seller will probably swap the faulty HDD and replace.


    You seem to have said that you do not want to go down the engineers report route. If that is the case, the only remedy is with the manufacturer, as you cannot force the retailer to act without this report.
