Employer refusing to provide p45 and/or p60

Whist working full time for the council, i took an evening job working in a bar. knowing the owners meant i wasnt worried about being paid on time etc. Turns out everyone was getting £5 p/h with no records, when i complained and quit the land lady put me on the books (PAYE), however i didnt go back - now my full time contract has ended and despite having all the details for that my tax return and credits/benefits from HMRC (approx £1500) is being held until i can provide HMRC with evidence of my income at the pub. So the pub is dodgy, and she obviously regrets putting me on the books etc. However without it i cant afford the rent/bills, i earned about £2-300 in about 5 weeks, and i know that with or without this the numbers owed from HMRC will not change dramatically. Any advice??


- HMRC say they cant find out themselves, and they also say they cant see how much ive been paid in benefits (7 weeks JSA) from the beginning of the year. (what do HMRC do??? :) , however im yet to make any official complaints with HMRC scince they asked for evidence p45/60 from each employer.

  • apparently not good enough as they dont indicate how much went on Tax & NI and also the first few were cash :(

    Strange. I know HMRC can find this information out themselfs (except cash ofc) because when I filled my tax credit forms out incorrectly (I had a part tme job I had actally forgotten about since I had only worked their 4months and had quite in June 2011 and was filling the forms out in August 2012) they came back to me with a higher figure...

    I guess all you can do is bug your employer for some kind of wage slip or something..did she even put it in her books properly for you to pay tax? Did you get £5 an hour or was it abit less due to tax?

    You could tell her you would be willing to put it as self employed if she didn't do it properly as long as she gives you some kind of proof what she paid you? (Not sure if that would work.)

  • We they say they cant, maybe becuase the pub doesnt file anything with HMRC!, its proper dodgy. Im sending all my other employment details off to to hmrc, leaving solely the tax/pay/jhours/dates from the pub job, give them a week , then just tell hmrc they refuse to provide it because they are stiching up all their employee's - however im thinking this wont help me and my finances much

    If they are over 21 the minimum wage is £6.19 per hour (and goes up to £6.31 next month).

    Since HMRC enforces that, they are likely to want to know more!
