    Well this was unexpected...

Filled in a "soft" appeal on the PE web-site using the last post by coupon-mad as a template. I emphasized that I would be appealing about incorrect signage but didn't mention I had photos etc. I also said I am a business customer at PC World, which I didn't mention here although I can't see why that would make a difference. Other than that pretty much as the post above.

Yesterday evening I received this e-mail...

    Dear Sir / Madam,

We refer to the Parking Charge incurred on 24 August 2013 at 16:18:48, at Barnstaple Retail Park car park.

We can confirm that this Charge has been cancelled and there is no outstanding payment due on this account.

    Kind Regards,

    ParkingEye Team

Not really sure why this got cancelled at this stage as its seems most on here go on to POPLA. I can only imagine that the PC World manager tipped the balance (although he said there was nothing he could do)

Weird- but in a good way

Thanks to all who give advice on these forums. Jolly Splendid Stuff

I suspect it was either that they ID'd you from this thread and knew they'd lose a forum-led POPLA appeal. PE have at least one staff member who reads these forums. Or they jumped because you said you were a business customer of PC World and you complained enough!

    Well done! :D

  • I parked in the Barnstaple Retail park and took my (nervous) dog forma prebooked groom room appointment. It took over 2 hours but we waited in the car park for her - we did not see any of the signs but as we were legitimate customers, I wouldn't have been worried anyway. Parking Eye have taken me to court and won't go through the small claims court. They are insisting on going to county court and are VERY threatening about how many cases they have won.

The pet store have tried to help but the parking company will not back down. I'd be grateful to anyone for their help here.

Oh dear - you've really misunderstood this process and you need to read the Parking Prankster's Guide to defending a PE small claim (which are heard at your local COUNTY court!

Have a read of his blog today and click on all the blue links on the right (lots of wins recently v PE!):

    http://parking-prankster.blogspot.co.uk/2014/03/parkingeye-lose-in-court-bristol-retail.html

Also read the entry on that blog from today, about the two court claims cancelled by the robust letter of complaint to the actual landowner, you can do that too. You should be doing that too!! COMPLAIN, NOT JUST TO THE PET STORE.

Having said that, you posted on an old forum thread from 2013, don't appear to have found page one of this forum yet which is FULL of 2014 advice & threads, and didn't even Google to discover that the small claims track is a case heard in your local county court. Good luck with your court case and I sincerely hope you have time to now research your defence better...I am concerned what you've put as your defence so far if you've not even found the Prankster's Guide or my advice about small claims cases here:

    https://forums.moneysavingexpert.com/discussion/4816822

Read the links in post #5 in that sticky thread which was at the top of this forum all along. Once you've read those links and got a copy of the Prankster's Guide to defending PE small claims, and read it and updated your defence!! I encourage you THEN to start your own thread to try to salvage a court win here after better research.

DO NOT POST HERE. THIS IS AN OLD THREAD. NOT SURE HOW TO START A NEW THREAD? THAT'S BECAUSE YOU AREN'T ON PAGE ONE OF THE FORUM.

Why you've jumped in on a thread from September of last year about ParkingEye in Barnstaple to ask about Smart Parking in Scotland I've no idea , but DRP seem to have given you one big clue:

Please note, we are not a legal advice forum. I personally don't get involved in critiquing court case Defences/Witness Statements, so unable to help on that front. Please don't ask. .

I provide only my personal opinion, it is not a legal opinion, it is simply a personal one. I am not a lawyer.
