    If a company fobs you off by saying “go to the maker instead”, it's wrong. It's the retailer's job to sort it.
    It doesn't matter if it's an iPod from a high street shop or a designer frock from a department store. If something's broken, torn, ripped or faulty, the seller has a legal duty to put it right as your contract is with them.

    They are fobbing you off, though the manufacturer may assist.

    Legally its their responsibility, if they subsequently claim off their supplier for the fault that is their issue but their obligations to you are not impacted by this.

    Remind them of their statutory obligations and if they dont respond then send a letter before action giving them 14 days to resolve the matter otherwise you will issue county court proceedings against them
