Refund

I ordered goods and paid from a shop last Monday and arranged a delivery for last Friday. The shop rang on The Thursday to say they were unable to deliver and rearranged for Monday. On Sunday they contact me again to say they again could not deliver. I had to arrange to take time of work and for someone to cover me. As the shop cancelled twice I said OK I want a refund and the order cancelled as it was costing me money. I was not shown any terms of business and only received a invoice statement with confirmation of my payment. The shop says it will not refund me and has referred me to terms of business on its website. It has offered to deliver the goods or a credit note. Am I entitled to my money back?

    No, sorry, you are not.

    However, you might well be able to recover any losses because of waiting for deliveries, etc.

    Have a read of MSE's Failed Delivery guide.

    I would be asking them to refund the delivery charge, at least.

    OP may be entitled to a refund if friday delivery was discussed prior to confirming as it would then form part of the retailers contractual obligations.

    If it was discussed after the contract was formed, perhaps a time is of the essence letter may help either expediate the delivery (or a refund if delivery isn't forthcoming).

    It's a little unclear, did you buy from the shop in person or via telephone/Internet?
    If you bought at a distance, you're entitled to return the item and rescind the contract within seven working days of delivery (starting the day after delivery)
    If you bought it face to face in a shop, then unfortunately, if you want a refund, you're probably reliant on their refund policy/goodwill.

    OP - what was the exact timetable of events? Who said what, agreed what, and when?
  • Items were bought in person from a shop I agreed a delivery date then. The shop didn't provide a order form just an receipt and specified no terms of business. Having failed to deliver twice and I had to take time off (as items needed fitting) this was part of the service. I know I can potentially claim for loss of earnings. However my confidence in the supplier is very low and I do not believe they have been entirely honest in their dealings. I would rather be refunded if possible!
