H Samuel cancelled my order

I placed an order with H Samuel on the 29/08/13 for two watches that were 1/3 of their RRP and in stock and available to dispatch. Today I received an email saying that the watches were not in stock and my order had been cancelled.

The watches are online at their full RRP in stock and I also rang my local store who informed me that she could see both of the watches in the system and they could be ordered into store for the next day. As the watches are definately in stock and the email I recieved states the fact they are not is the only reason my order has been cancelled (nothing to do with incorrect pricing etc.) do I have any rights to demand they honour the price I originally paid?

    No rights at all. See the sticky at the top of this forum Do shops have to sell at the advertised price?

    Just to expand on the above, unfortunately as per the T's and C's the contract is not formed until the items are despatched. Therefore they are free to reject your order up to that point.
  • Thanks for the heads up. Seems like they've got all the loop holes covered then. Was still worth a rant down the phone at them for my own benefit.
  • Morally you win. I'd contact watchdog. It's this sort of legalised naff customer service they like to publicise.

    I wouldn't bother with that OP.

    They have decided, for whatever reason, that they don't want to sell the things to you.

    That really is the end of the matter.

    'They' haven't got all the loopholes covered.

    It is consumer law, so it isn't a loophole.

    Really? I though a loop hole was a flaw in the law that can be taken advantage of. Therefore as this law was intended to allow retailers to decide when the contract was formed, it is not a loophole.

    By your definition, the SoGA has a loophole that allows retailers to repair goods rather than refund straight away.

    It must also be a loophole that allows retailers to run sales and set their own prices
