Michael Kors Watch - HELP!!!!

I received a Michael Kors rose gold watch for christmas last year (December 2012), which my boyfriend bought from a shop on eBay.

The watch was not cheap, and for such an expensive item I had high expectations for it to last for years to come. However, over the past 6 months, I have found the watch has slowly become duller in colour, and the rose gold colour has disappeared. I am now left with a dull, bronze looking strap, and a rose gold facing on the watch, which is all mish-mash and looks terrible.

I contacted the seller on eBay who inform me that they only have a 6 month guarantee, which low and behold, had ended by time I got in touch by literally 2-3 days.

My next port of call was Ernest Jones, to see if I could get a new strap, hopefully for a reasonable price. After being quoted £125, which is over half the value of the original new item, I declined and I am now in a bit of a pickle.

I have contacted Michael Kors themselves, who told me if I haven't bought the watch from a store that they consider a legitimate seller, (i.e. not eBay), then basically I don't stand a chance of getting my international manufacturers guarantee honored. I DO have this document and the original box etc. however I do not have a dispatch note from the seller, which is one thing they asked for.

I wanted to know if anybody has been through the same situation and has any advice for me? I don't want to be left with a poorly conditioned watch after 9 months. I've spent 3 months fighting to try and get something to come of it and I'm getting tired now :(. Any help or advice would be appreciated.

  • Hmmmm named watch, eBay......could well be a fake tbh.

    After 6 months you have to prove the fault is inherent. So can you get it assessed? Will the manufacturer do that for you? To check that and if it is legit?

    The manufacturers warranty, forget it, their terms are binding it is in addition to your statutory rights.

    9 months on and presuming he went through PayPal. His only option would be small claims court. If it were not real or was inherently a faulty.
  • The watch is legit, I have had it sent off to the Michael Kors service centre via Ernest Jones to see if they could repair it. They gave me a quote for repair, so I am assuming they would inform me if it was a replica at this stage.

    I have all the correct documentation with the watch as well, guarantee, authenticity certificate etc. It was bought through a jewellery shop ON eBay, not as an auction by a private seller.

    He did pay by paypal, should I inform eBay of the condition of the watch after a short time? I've been researching other customer complaints about the same issue, it seems to be a very common occurrence with the rose gold colouring. It's just such a lot of money to lose, and to be honest, it's just caused hassle. Something you don't expect from a Christmas present.

    If you do not meet the terms of the manufacturers warranty, then you don't. It is in addition to your statutory rights and basically you have to accept them.

    Your only chance is to go through the SOGA process with the seller once you are sure the fault is inherent, back up all your claims with evidence, then take him to small claims.

    Also buying it ON ebay, or from a private seller. It matters not. There are more fakes than not on ebay, even via shop fronts.

    Legally, any issue you have is with the seller. Court may be the only recourse, but could be more trouble than it is worth.
  • Thank you for your replies, they are really helpful. I will contact the seller again and express that my confidence in the products authenticity is low, and that I'm looking to report them to eBay and take the matter further.

    Hopefully this will shake them up and they will do something about it. Maybe I'll just have to take it on the chin and inform everyone else NOT to purchase any Rose Gold items from Michael Kors.

    Ebay won't be the slightest bit interested after this length of time.

    The seller will know this too.
  • If the ebay seller is a business then go down the SOGA, Ask the manufacturer to state this is an inherent fault and then ask the retailer to remedy this.
    Don't trust a forum for advice. Get proper paid advice. Any advice given should always be checked
  • I have spoken to Michael Kors services, and explained my situation. The seller has not stamped my guarantee, therefore making it invalid. I don't think I have a leg to stand on. I've managed to find proof of purchase for the item (which Michael Kors themselves asked for), however with out the stamp on the guarantee it isn't worth a thing.

    I will post and let you know what the seller comes back with.
  • Really you haven't a leg to stand on with the seller, and ebay will not be interested because it is past the 45 days. I have often bought watches from jewellers and I have never had the guarantee stamped, the receipt is my guarantee, so it may help if you have a receipt stating the name and make of the watch and date bought and try using that.

    I also have a rose gold Michael Kors watch.

    The same thing has happened to mine. I put it down to the fact that, as advertised, it was rose gold plated. Mine has just worn a bit where it has been against a desk whilst I've been typing.

    Although it's not always right, the prices of things are largely more to do with the name of the designer and not the quality.

    It's very annoying, I know but, like you've already said, you probably don't really have a leg to stand on.
