Hi guys,
thanks loads for your advice up to now. I have just had my letter back from the parking company rejecting my appeal. So now I have to appeal to popla. Can anyone help with what I need to include in this. I had found some fantastic links on how to win a popla appeal and what to include previously but my daft !!! computer decided to reboot and I can't find them again.
Thanks again

Here's a similar question I replied to earlier. Follow the same advice. Sorry to copy from elsewhere, but it does save typing time!Have a good read of the sticky 'POPLA Decisions' at the top of the forum index. Read the latest 4 or so pages to start giving you some ideas. Don't rush into writing your appeal, it will pay dividends doing a good bit of reading so that you become a bit more comfortable with all the technical/legal bits of this.
Also have a look around on Pepipoo - this is their 'Completed Cases' thread covering similar wins.
http://forums.pepipoo.com/index.php?act=SF&s=&f=17
But don't take your eye off the ball in terms of the POPLA deadline for submission of your appeal.
One thing to remember is that POPLA have no interest in mitigating circumstances (telling them your 'story', no matter how good it is) so you have to base your appeal on the more technical side of things. Don't be phased by that, just do some reading and if uncertain about any of the points you are considering, just ask.
Main points of winning appeals have been:
* Pre-estimate of losses - putting the PPC to proof on detailing these.
* Signage
* Lack of proprietary interest in the land
* Contract details between the landowner and PPCPlease note, we are not a legal advice forum. I personally don't get involved in critiquing court case Defences/Witness Statements, so unable to help on that front. Please don't ask. .
I provide only my personal opinion, it is not a legal opinion, it is simply a personal one. I am not a lawyer.

I would just like to update on my situation. I have just received by response from POPLA and they have allowed my appeal. This is great news. I haven't planned to upload the full report unless people want it? Parking eye did respond to POPLA and the ground the appeal stood were down to no pre-estimation of loss. I hope this helps others who may wish to appeal on these grounds.
Thanks to everyone for their help, I never expected this and am delighted.

Well done, just seen this, we certainly did expect it and our 100% win rate continues!
In fact we would love to see a copy of the full decision including the Assessor's name as it helps other newbies. You could post it here and/or in the POPLA decisions thread at the top of the forum.PRIVATE 'PCN'? DON'T PAY BUT DON'T IGNORE IT (except N.Ireland).
