Hi,
I have sent details of my late mums bank accounts to DWP as she was probably claiming too much pension credit...The sum total of all her assets was around 30k... They have asked for details starting in 2003 and ending in 2010.I have sent everything to them..the amount in her bank accounts fluctuated over the years between 10k and 30k..It has now been 5 weeks plus since I sent the details..Can anyone out there tell me 1) when am I likely to hear from them and 2) how much would I need to pay back to them and do they give you time to pay...?

1) Once they've worked through a complicated assessment to determine how much has been overpaid: weeks, I suspect.
2) Unless you dispute it, the full amount calculated as overpaid will need to be repaid. The capital limit from memory was £6k in 2003. The expectation is that this would be met from her estate, and so there would be no need for time to pay?0 -

If your mother was given an AIP - assessed income period - when she was first given PC, it wouldn't matter that her money went above £10k until she was reassessed.0 -
Remember to ask for the DWP/council to apply the 'Diminishing capital rule' when it comes to any overpayments that lasted over a long period of time.
This will reduce any bill quite a fair bit, which is probably why the DWP never seem to want to apply it unless asked first.1 -
