Recieved pcn ( from tower rd Newquay).

Hi, just returned from a holiday in Newquay and Recieved a pcn from parking eye. Luckily i have found the tickets relevant to the supposed offence .In this car park you have the usual parking tariff showing the amounts to pay and the time you can stay. There is another sign to the left of this basically stating that if you over stay your original ticket then you can purchase the extra time before you exit the car park ! We purchased a ticket which ran from 15.02 until 17.02 £3.20. Thinking that would be sufficient of we all went . We went to the town around the usual shops ,had something to eat and decided to head towards fistral beach. Boardmasters was on and thought we would have a look around. When we returned to the car obviously we had over stay our ticket, so we stood at the pay machine reading the signage trying to work out what extra to pay. Very confusing as the time was about 19.50 we were trying to work out how much to pay! We weren't sure how to work it out exactly as from 18.00pm the tarrif changes, we needed to pay from 17.02 until now .We paid an extra £4.80 thinking that would be plenty and our ticket was issued at 20.10 .We thought this was fine as we had now paid £ 8 to park for 5 hours and 8 mins . We have appealed to parking eye by email showing evidence of the tickets purchased ,which they rejected now we have to go to a popla appeal :mad: does anyone have any advice on this due to our situation???

    So you proved to them that you paid and they rejected this, did you take pictures of the signs? You did keep the original receipts showing you paid ? Are you living in Scotland or NI ?

    When posting a parking issue on MSE do not reveal any information that may enable PPCs to identify you. They DO monitor the forum.
    We don't need the following to help you.
    Name, Address, PCN Number, Exact Date Of Incident, Date On Invoice, Reg Number, Vehicle Picture, The Time You Entered & Left Car Park, Or The Amount of Time You Overstayed.

  • In their rejecion or even intial charge notice, were they specific about what the alleged "offence" was. They really MUST be clear what they thought you did/didn't pay for. Just saying "you owe us £100" is frankly a load of BS, and they know it.

    Take it to POPLA, use the "we've paid, so tough" route, as well as many many more points which you can find by searching around here.
  • Hi ,I didn't take a picture of the signs,would be handy if someone on here lived close to Tower rd car park Newquay and could get me a picture of the signs. I have the tickets i purchased, I live in England ,does this alter anything.
    Parking eye have alleged (By either not purchasing the appropriate parking time or by remaining at the car park for longer than permitted, in accordance with the terms and conditions set out in the signage, the parking charge is now payable to parking eye ltd , as the creditor ).
    It is almost as if they don't know there is a sign next to the pay and display sign , which tells you not to worry if you've over stayed and just to pay for the extra time before you leave . You have to enter a vehicle reg number to do this so surely the camera and machine verify buying the extra ticket and leaving?
    Does anyone have a template of how and what areas to cover when going to popla that are relevant to this situation ?

    But which is it? If they don't know, then surely you're not expected to be able to second guess in order to take a view on how valid their request for ridiculous amounts of money is.

    It's not unknown for PE and other like-minded extortionists to make up more silly rules such that if you were in the car park during the day, then the daytime "hourly rate" extends into the evning "flat fee" period. It's just another one of their dodgy wheezes to try to squeeze money out of the weak and foolish.

    Treat them with the contempt they deserve (which is an awful lot of contempt).

    One of the things I noticed from a recent recce around the PE sites* at the Headland end of Newquay was the potential confusion for a driver who wished to park before 18.00 and then stay on longer.

    (* all except the Holy Trinity Church car park, PE 'operated', which gives a day rate until 22.00 )

    There is absolutely no confusion at the Council P&D car parks as it clearly states that you pay the relevant fees up to 18.00 plus the evening charge.

    Anyway I wondered when this little PE ruse to cause confusion would come up and it didn't take long. Confusion = Money to Parking Eye

    Based on the advertised charges, £3.20 for the initial 2 hours plus £2.50 evening rate from 18.00 plus £1.80 for the hour from 17.02 to 18.00 would be any fair persons estimate of what you would have to pay, total £7.50. In fact you paid more than the three hour rate £4.80 ( which would have taken you to 18.02 ) plus £2.50 eve rate total £7.30 by 70p or 50p over taking 2hrs, 1hr plus eve rate.

    Even an appeal with copies of the tickets counts for nothing in PEworld and somewhere along their line you have transgressed.

    What you haven't told us is the time PE clocked you in to the car park and the time they clocked you out, their stated reason for imposing the charge, as per their first letter to you and their reasons for rejecting your appeal.

    One of the fantastic benefits for PE at Newquay is that most people are back at home, often hundreds of miles away before they get the PCN. No chance to go back and see the signs, check the charges and in most cases the ticket is binned when the vehicle is tidied up after the holiday.

    Here is a piece of advice for anyone paying in a PPC operated P&D car park, keep the ticket for at least a month.

    Parking Eye cannot show that there was any loss, for a start. Read the links and draft your POPLA appeal and show it here first for fine-tuning.

    I haven't got the details of the top up signs at Tower Road but am fairly certain they are the same text as the ones as Fistral
    which actually give an example

    " eg if you have paid for £3.20 for two hours but overstayed by 30 minutes, just pay an another £1.80p (1hr)"
  • Hi again, We were clocked into the Tower rd car park at 14:54:45 and were clocked out at 20:12:59 .As i did write they are saying " either by not purchasing the appropriate parking time or by remaining at the car park for longer than permitted. They also state I am notified under paragraph 9 (2) (b) of schedule 4 of the protection of freedoms act 2012 ? Means nothing to me !
    Also There was no example on the sign as what amounts to pay,otherwise it would have straight forwards.

    OK, there is no massive gap between when you entered the car park and when you paid for the ticket at 15.02

    There is no clear reason for PE imposing the charge in terms of what their signage says and what you actually paid.

    PE have offered a dual choice as to why they are trying to relieve you of £60.

    Did they give a reason for rejecting the appeal ?

    Did they give you a POPLA code on their rejection ?

    I think this is well worth reporting to Cornwall Council Trading Standards as well as a POPLA appeal.
  • Hi,the reason they gave for rejecting the appeal was : a valid parking ticket was not purchased or the appropriate parking time on the date of the parking event. I have been issued a popla code .
    I have been searching through forum trying to find info for popla appeal a lot of it seems quite mind boggling with acts and legal jargon i am not familiar with. Obviously the main areas to include would be the unclear signage, !!!! Can anyone tell me what other areas are appropriate !
