Obtaining deposit after tenancy- experiences please?

    My landlord has done all sorts, moved in feb 06, 6 months shorthold tenancy, which has not been renewed!! He keeps up tp 5 or 6 cars on my drive, one got attacked last year, and burnt out, right outside my house, the remains are now on driveway!!Gas fire was taken out by corgi in feb, this was after me pushing him to get them in, as he hadn't done it!! Still not put new one in, only one radiator downstairs!! I've heard from ppl around here, tenants before have complained abt the cars, and hes chucked them out, dont know true this is!! But he's not the perfect landlord as you can see!! We live and learn!!

    It's because of people like you that we have now started asking for more than one month's rent to cover the deposit.
    All you do is make it harder for good honest tenant's to raise the extra to obtain somewhere decent to rent.
    Mind it does become quite fun when I track you down and come after you, catching up is great

    and its because of landlords like you we now have the tenancy deposit scheme.

    I wouldn't mind you coming and tracking me down...then what?

    I would withhold the last months rent. PERIOD unless your deposit is in the deposit scheme.

    What? I have never withheld a deposit where have you got that from?
    Why would I have to pay my tenant's deposit into the deposit scheme? They have been renting with me before it came into force.
    I am all for schemes like this if it could also keep tenant's keeping to their side of the agreement.

    You really have been through it, maybe a move to suffolk could benefit you.

    In your position, I'd take photos of the condition of the property before you leave, so you have evidence to support your claim in the event that you have a dispute with the agent. It's annoying to take time off work, but I think it would be best for you to be present at the check-out inventory, and I would ask for a copy of the inventory as well. Is it possible for the agent to perform the inventory on the day you leave? This would also mean that meter readings were accurate. Do you know what the cause of the peeling paint in the bathroom? If it's easily remedied then I'd try and repair it myself - a little bit of DIY is certainly worth it if it means getting your deposit back!

  • I have had a complete nightmare trying to get back the deposit from a property my daughter rented with friends. It has taken 11 months, 1 County Court Judgement (the landlord has 8 against him altogether), 1 Warrant of Execution, 5 visits from Court Bailiffs (who gave up in the end) and finally, I had to engage the services of a private debt collector, who charges 12%, to get the money back! I did everything absolutely by the book. The rent was paid on time, the property left immaculate, all final bills paid in full but it made no difference. The landlord just saw our deposit of £3600 as a windfall and choose not to return it. My daughter is now coming to the end of the tenancy at the property she is living in now and we are SERIOUSLY thinking of witholding the last months rent so we don't have all these problems again.

    It shouldn't be a problem in the future with these new deposit protection schemes.

    Almost all LLs keep deposits for themselves IME. Perhaps I'm unlucky. I don't think so though.

    Hmmm,

    just having fun with my ex LL at the mo.

    When we moved in the inventory supplied by the agency was for the wrong flat (they have several in the building) i.e. wrong colour tiling, wrong make of washing machine, features in rooms that didn't have them. etc...

    We agreed with agency to write out inventory and return to them.

    When we moved out it was checked against our inventory and letting agency had no problem with the condition.
    We moved out on the 25th of april and still have yet to recive our deposit, according to letting agency landlord hasn't signed the check out form depsite reciving two copies now.

    I have a feeling we are in for fun and games, have threatened letting agency today that if we don't get deposit back in 7 days then we will take action both against landlord and them.

    You will still have to pay their deposit into a scheme if/when you renew the contract, if it is an actual renewal (i.e. new contract signed). If it is the old contract rolling over (periodic shorthold tenancy) then you do not need to protect their deposit.

    We renewed our agreement on the 1st June and were not informed within 14 days (as required by law) of the TDS our landlord is using. We now have the right to apply for a court order against them which would force them to protect the deposit (if they havn't done so) AND pay us a penalty of 3 times the deposit. So it could get expensive if you 'forget' and your tenants are clued up.
