Partial Refund - Does This Sound Fair??

Ok, just looking to see if people think this is a fair outcome,

Purchased 2 Leather 3 Seat Sofa's 23 Months ago.

Purchase Price, £1300 for the pair.

Was cleaning them this week and noticed a small tear on a seam on the lower bolster, (Not visible unless you move the Bolster to clean it), but it has split about 5mm away from the seam in a jagged tear.

On checking the other sofa the same seam is starting to strech it has not split yet but it is showing signs of going, again not visible in normal use only when you pull the bolster to clean in it.

Went back to supplying shop, initial response was 1 Year Guarantee. Sorry nothing we can do,

Told them not happy and felt it was an issue covered by Sale of Goods Act. They agreed to send someone out to inspect,

Turned up as agreed took photos and said would get back to me.

They called today and said that on inspecting the photos they would offer 2 solutions.

1: They would collect the sofas and give me a credit note of £800 to use in store

or

2: They would refund me £200 and call it it a final settlement with no further claim to be made.

Said I felt the figures were too low.

Now come back to me with

1: Collect sofas and give me a £900 Credit note
2: Refund me £400 as a final settlement and no further claim

I think this fair, and am tempted to agree to the £400 refund, the Sofas have held up well apart from the small tear on the Bolster, which I can probably patch over to prevent further damage and it is not in view anyway.

Must say apart from the initial denial of liability they have been very prompt and helpful,

What do you think £400 and run!!!!

  • I'd take the £400, it sounds quite fair to me for a defect that isn't visible especially if you can make repairs that will prevent it from getting worse/becoming visible.
    Common sense?...There's nothing common about sense!
  • Yep I'd take the £400 and run. Do a hidden repair to stop the area getting any worse.

    yes take the £400 and then find a local upholsterer and see if they can repair it.

    Thanks, yes that was my gut feelin, they have been very fair really

    Spoke to them just before they closed this evening andthey refunded amount to my card while I was on the phone, so all in all. Happy with result.

    that's good then. now next job is find an upholsterer to repair it before it gets worse. from what you have described i cant see it being too expensive
