Mortgage/Council house ?

Hi,

Our property have 3 bedrooms, me, my husband and my baby in 1 room, my husband's two brothers lives in the other 2 bedrooms. (One of them is a smoker who smokes in his room). They have a mortgage on this property.
As I know, my husband cannot apply for council housing because three of them own this property. The main things is, our room is too small (overcrowded). If we move out, my husband's salary is not enough to afford a place to rent.
Is there any exception for us if we can apply for council housing? Also, my baby receives disability living allowance and I am not working now.

    As your husband part owns a property already then I think the answer will be no. Can you not use the presumably bigger living room as your room if the other brothers live in their bedrooms?

    Our place is too small, one of his brother bedroom is the one bigger one, but we cannot change because he is the smoker. And also, my baby have heart problem.

    He smokes in the house when a baby has heart problems? What a selfish individual.

    Anyway, you can apply for council housing and answer any questions that are asked.

    There's probably a better section for this thread though.

    Are your husband's brothers in a position to buy him out? Would they want to do that?

    It doesn't sound as though having all three brothers (plus wives, children, and potential future wives and children) living in the same house is a sustainable arrangement.

    Honestly, I really feel stressed at the moment. I am worried if I fill out the council house application form and they know my husband owns the property, we will get refused directly without any appeal. They don't even consider our situation.
    But, we really cannot afford to rent another place, I am not working, we are overcrowded, place is too small, my baby has heart problem......

    But he only owns one-third of the property. Until you ask your council, you won't know for sure what will happen - if you ask for help because of the overcrowding/your baby's health/your high stress levels something may be possible.

    Have you looked at the Shelter website - http://england.shelter.org.uk/get_advice/paying_for_a_home
    There are schemes to help with a deposit on a rented place.

    also you could contact HA's , they may be able to help, your local council should have a list of phone numbers/addresses for them.

    as others have said, ask the council , you don't know until you ask,
    your situation sounds awful and at the end of the day your priority is with your baby

    Most councils will not rehome someone who is an owner or part owner of a property.

  • It seems I haven't got choice to apply council house when my husband's name on this property.
    If my husband take off his name on this property, under our status (cannot afford to rent another place, I am not working, we are overcrowded, place is too small, my baby has heart problem......) questions :
    1) Is it more easier to get the council house ?
    2) Once he take off his name, when should we apply council house ?
    3) How long do we need to wait to get the council house?
