Working 16+ hours but on a 12-15 hour contract

I'm applying for jobs at the moment but a lot of jobs are contracted at 12-15 hour contracts with overtime available.
If I get a job before the 30th September I qualify for the back to work payment of £40 a week for a year, but will I get tht if I have a contract that states only 12 hours but I am in fact working 20? Or even a zero hour carer contract?
I've avoided applying for less than 16 hours so far, but that has ruled out a lot of jobs for me to apply to.
Thanks
I also need more than 16 hours for WTC, how does that work with a smaller contract?

Anyone have any idea?

If you are single - then you'd need 30 hours min for WTC to apply, but you have not said if that is the case. Or are you a lone parent/part of a couple? I assume you are over 25 years old.
However taking a job that is 12-15 hours will not affect your back to work credit, a Zero hours one may though - not too sure of that one. Someone else who has been in that situation is the only one that can answer a zero hours/back to work credit situation.0 -
Thank you
I am a lone disabled parent. I turn 25 in 2 weeks.

Do you think you will qualify for the disability premium on WTC?
If you qualify, you can claim WTC with the disability premium on 16+ hours, not 30.

I think I might but I'm not sure... I'm in between doctors at the moment so not sure what is happening with regards to my treatment.0 -
http://www.hmrc.gov.uk/taxcredits/start/who-qualifies/workingtaxcredit/disability.htm - click on this link and just under the extra help bit there is a download help sheet that will tell you how you may qualify for the Dis element of WTC.
If you can meet all 3 conditions then you should be able to get it.0 -
No on Income Support as my daughter is 3.
Ah, not sure of the rules on that, but if you were on ESA you could have done permitted work under 16 hours and under £99.50.
You could always apply for two jobs under 16 hours and combine them both? That's what I am doing - 2 x 12 hour jobs.0 -

Thank-you, I definitely meet two, nut I. Not sure about whether the person I see regularly is medically qualified ill have to ask when I see her next. I have a case review soon which is with a psychiatrist but my care package is such a mess at the moment as my care coordinator left and they've put me with a less intensive team, I have no idea what is going on haha.0
