  • Just had an appeal held up against KPS for a parking ticket in Mousehole.

    I had bought a ticket and placed it on my dashboard but it had blown off in between placing it there and closing the door.

    My grounds for appeal were simple;

    - I had bought a ticket so KPS had not lost any revenue;
    - The car park is on the see front, so its forseeable that there is going to be windy;
    - KPS do not provide sticky labels to the tickets so I can fulfill my part of the contract of "displaying" the ticket
    - The car park is not lit at night - so I was unable to see whether it was there or not.


    POPLA held up the appeal on the first point - the burden off proof is on the operator to determine what losses they had incurred... as they hadnt lost anything the case was held up in my favour :))


    POPLA does work.... it took a few months but the site was easy to use and process v straightforward.

  • I have just been ticketed for the exact same reason, the ticket I purchased must have flipped over when I closed the door (is really windy in Mousehold today) and I didn't realise - but £100 fine.. for that??? Having read your post I am going to appeal. Any pointers?

    3) its not a fine , its a parking charge notice invoice (an invoice for a pcn)
