This is incorrect, in the short term ESA is definately the correct benefit to claim. ESA is designed to accomodate short term claims with sicknotes. Having a sicknote is the only "term" (of terms relating to sickness atleast) of ESA that he will need to meet untill the WCA.
But it does definately mean he is eligible for ESA
sorry but if all depends what his note says, if it says he can work with limitations then they may send him straight to JSA, JSA might send him back again if they will not accept those limitations, so it's not as simple as you say that a fit note is all he needs, I know as this is exactly what happened to me.
He may even get accessed on esa straight away so he could be even kicked off that straight away or very soon after applying but it may take longer, so it's the way to go...I had already said that esa was the way to go.0 -
No, you are wrong. ESA is for people who have a "Limited Capacity to work" if the sicknote says "Limited Capacity to Work" then this will be good enough for ESA. I am not privy on what happened to you, maybe you misunderstood.
One thing though... the illness on the sicknote has to be a valid illness, if the sicknote says "berevement" or "bereaved" as the incapacity then it is not a valid sicknote.... it would have to say stress, depression or nervous breakdown or some such thing.0 -

ESA is if you can't work, there are 2 groups, one that if you will be fit for work in the new future and one where you will not be fit for work any time soon, both groups you have to be unable to work, sorry but those are the facts not your spin on them.0 -

And you are wrong, WRAG and SG do NOT mean that you are unable to work. WRAG definately means you are capable of doing something and DWP will help you to acheive that goal. SG may or may not be unable to work, SG claimants can do part time work if they want to. So can WRAG if they want to.0 -

wrong, it's called the work group not because you can work but because they will support you in "actions to get back to work" not work but get back to work in the near future, if you can work you go on Job seekers allowance, the clue is in the name, actions to get in a position to get work one day is not the same as "working", trust me, if you can work they kick you off esa, in fact if you can breath you will be kicked off it many times :rotfl:

easy I phoned them up againthey said I had to go back to JSA , this time JSA agreed to accept me with "limitations" on my job search".

Sorry guys, didnt mean to start a big debate! lol
In my case, my fit note does say unable to work because of the operation and the recovery time however I feel in myself that I am fit to work with limitations maybe in a office answering calls, maybe part time first of all and closer to home and not a 90 mile commute etc. I wouldnt be able to do the job I was employed to do for another year or so and dont think its fair on my work and colleagues. So yes, in my case its a short term claim and I am looking for work so I didnt know if I was to apply for JSA as I am seeking a job or claim for ESA due to docs orders and look for a job during this time for when the fit note expires.
I think the whole ESA thing is a potential mine field and allthough I think the goverment is right about getting people into work, I think they are picking on the wrong people to do this.
I'm ringing the benefits people later as my notice ends today and going for ESA Cont and I'll post later to update.0 -
Called them but as my postcode is not on thier system (newish build) that they have to send out all the forms and I need to send back with all the evidence etc. The lady did say I will need to be assesed but the change to JSA while claiming ESA is easy.
I dont seem to have the choiice whether or not to go on to ESA Cont or non Cont and they decide0 -
You do have the choice, one of the first questions is Do you want to claim ESA Income Related if you say 'No' to this question the form directs you to "ignore all questions coloured grey" or something like that. and it will be an ESA Conts only claim.
You will see when you get the form.0
