Housing Benefit claim help

Trying to help someone but unsure what LHA would be applicable.

Senario;

Three bedroomed private accommodation.

Tenants

T1 24 year old on income based ESA with mid rate care DLA
T2 18 year old claiming CA for T1
T3 20 year old apprentice

So help please as regards applying for HB.

Who should apply? What LHA are they entitled to?

Confused re: T1 eligible for one bed rate (himself) claiming with T2 and T3 as non dependents (eligibility then?) or all 3 claiming separately and eligible for what?

    T1 and T2 are half brother and sister. T1 is a friend.

    No tenancy at present. This is in anticipation. If a joint tenancy then presume they would all be eligible for Shared room rate including T1 with mid care DLA? (Would lose disability premium because of CA being claimed so not sure about this?)

    Could T1 have tenancy in sole name with T1 and T2 as non dependents? (ignoring whether he would be granted such a tenancy)

    If T1 takes the tenancy himself with 2 non dependants he should receive up to the 3 bed LHA rate with no deductions due to receiving a rate of DLA care.
    Forums can be/are a good guide to entitlement and it is good practice to back it up with clarification from the relevant department/specialist with written confirmation to safeguard yourself.

    Surely T1 would only received the LHA for either a 1 bed property or 2 if they can evidence the need for overnight care? Or does thia mean that having any number of non dependents living in their own house mean HB will be paid for the whole property whatever its size just because they receive DLA care? Just imagining someone claiming HB for a 6 bed house, having 5 wealthy friends living in there free of charge, just because they claim a DLA care benefit?

    Obviously only asking here as I don't know and am interested in answers.

    The answer is yes. If the tenant gets DLA Care middle or higher rate then there are no non dep deductions even if 100 non deps earning £1 million per year lived there.
    These are my own views and you should seek advice from your local Benefits Department or CAB.
