Odd situation...advice needed.

I bought a memory card from a HK seller a while back. When it turned up, it didn't work properly (corrupting data), and only held 1gb, not the advertised 4gb (even though it showed up as a 4gb card when I put it in my card reader, I could never get more than 1gb on it - would say card is full). Anyway, I went to paypal after contacting the seller. Paypal told me to send the card back by trackable delivery to the registered paypal address, which I did. The seller emailed me with a different address. Obviously, I used the paypal address. I gave Paypal the tracking number and was refunded my money. That was the end of it, or so I thought.

I've been watching to see when the card was delivered back to the seller, but all RM's website says is that it's been handed over to the Postal Service in HK. Today, the postman stuck a card through the door saying I had a signed for item to pick up from the post office (I wasn't in, obviously). The number on the card is the same as the item I sent back to HK, and it's been stamped "no such address" followed by a load of chinese. So, the question is: do I pick it up? If I do, can the seller come back and say he hasn't received it, as it will show up as having been delivered back to me. I did use the address registered with paypal, so can't see how I did anything wrong. We're talking about a £18 item, which cost me £6 to send back!! I'm not sending it back again. What do I do to avoid Paypal taking the money back from me, as the seller might argue about not having received the item back.

It might be worth phoning Paypal as you have done everything they told you to do and the seller should not be able to get out of refunding you.

I started a paypal dispute and had to send a mobile back to a seller due it being used not new, i sent it back by special delivery. the seller either wasn't in or refused to answer the door to the postman so it went to their local sorting office and postman left a card to tell the seller they had attempted delivery. i also emailed the seller to let him know.

i left it a couple of days but heard nothing from the seller and he did not collect the item. he was obviously trying to get out of giving me a refund. i phoned paypal and they agreed to refund me and said something along the lines of it being up to the buyer whether they decide to collect it or not, but because i had returned it and there was proof of where it was, and the seller knew where it was, paypal refunded me. i seem to remember the buyer then collected the phone the same or next day!
  • Paypal's already refunded me. That's the thing. They refunded me as soon as I provided them with the International Signed For tracking number. Since then, the item's been to HK and has just made it back to the UK, after the HK postal system sent it back, as the address he's got registered on his Paypal account doesn't exist.

I wonder if Paypal would undo the refund if you reported the seller to eBay for registering with a non-existent address? ;)

I did think about that. I think his Ebay address is the same. ;) Thing is, how can I prove the address doesn't exist? If I pick up the returned envelope, I'm sure it will say it on there (address does not exist). I could scan it and send it in to Ebay and Paypal, I suppose.

You've had your money back, and now the card, why take it any further??

Obviously you've completely ignored my first post. I have not got the item back - it's currently sitting in the Sorting Office. I sent it to the seller's registered paypal/ebay address. It came back as "address does not exist". Paypal has already refunded me. If I sign for the item back, the seller might try to get the refund reversed, as he can prove he hasn't received the item (and Paypal already has the tracking number). It's hardly my fault the seller's given false contact details. Furthermore, I don't want the item back - it's faulty and was misdescribed! I'm already £6 out of pocket for having to send the thing back International Signed for.

Thanks for your post, Dave. You've actually made up my mind for me now, as I'm going to report the seller for false contact information.

You might as well collect it.

    Why stir things up?

You've got your money back, and, if you collect it, or RM redeliver your item.

Which bit are you failing to understand? If I pick it up, the seller will be able to show it has been sent back to me and could ask for the refund to be reversed. The whole point of me being refunded in the first place was because the item was a duff fake (1gb card showing and advertised as a 4gb card). I don't want it. I want my money. By signing for it back, I could end up having my money taken back from me and given back to the seller. Get it yet?

"The seller emailed me with a different address"

Which would not be all that unreasonable given you sent it to the wrong address.

All I've got is that you sent it to the wrong address, but still managed to get your money back.

Think of this situation from the sellers point of view...

Sorry, but Paypal made it clear - send to the seller's registered paypal address, which I did. I phoned Paypal before sending to clarify this. I was told that under no circumstances was I to send it to a different address than the one registered with Paypal. Not my fault the seller has given false contact details to both Ebay and Paypal. I didn't send it to the wrong address.
