ppi appeal

hi all

just asking for others similar experiences really.

i lodged a ppi complaint to Barclaycard November 2011. this was rejected .
i therefore went to FOS around april 2012
they found in my favor .

Barclaycard had a right to appeal which they did.Now im still waiting to hear.

it been over a year,14 months I .called FOS last week and my case is still waiting to be reviewed.
Also what do you think chances of other party appealing and winning are?

    Depends on your complaints reasons and why Barclays think the adjudicator was wrong. Historically, the ombudsman dont tend to overrule the adjudicator that often. However, with PPI, there are more numbers of lower skilled adjudicators who do seem to be making more errors and overturning does appear to be more common with these. However, it really does depend on the reasons being applied.

    my reasons were at the time my employment package sickness life insurance benefit would have covered .

    FOS upheld in my favour due to above and the poor quality evidence barclaycard provided.

    barclaycard appealed using the same poor quality documents stating that i was given a choice.

    Not a strong reason for mortgages. used to be a strong reason with loan and credit card but reading recent FOS publications on complaints, it is not a dead cert reason. Especially on non-advised applications. Tends to be more likely to work on advised applications.

    That is not a valid reason to uphold a complaint. If that is the only thing then I can see why they are referring it. The decision needs to be made on the balance of probabilities based on the evidence available. The work benefits could apply if advised. Was this a postal/online application or a branch/phone based one?
