Garden gate - our responsibility or builders'?

Hi guys, just a quick query.

My partner and I have bought a new build property from Taylor Wimpey and have just moved in to find a garden fence with a gap where the gate should be. We have been told that this is our responsibility to purchase.

When buying the property we were told the fence was TW's responsibility as it backs onto a car park for the block of apartments next to our house. The plans also mark the plot boundary as TW's responsibility and no mention was made of the fact the gate would not be included.

Anyone got any idea on whether TW are fair and correct in saying this or are they just trying to cut costs by hoping we won't object?

  • I live on a TW site that is not yet complete. All the houses have a gate provided by the builder but I do know that there can be differences between sites. For example I have a corner plot and the builders put up a wall as one of my boundaries. My friend on another site has a similar plot but just a fence on her outside boundary. My site has an upgraded fence for internal boundaries whereas my friend could choose a cheaper one or the more pricey one.

    However it is very odd that you don't have a gate! What are the other houses like? Knock on a door and ask if they paid for their gate. Was it the sales person or site manager that you spoke to? My sales person tried to sell anything and everything to me but the site manager was really helpful and did some bits for free.

    Personally I would expect a gate but then a lot of things about a new build are a lot less 'finished' than I would expect when buying a house.
  • They are just trying to blag their way out of paying for a gate. Tell them to install one or you will take them to Small Claims Court.

    I bought a TW in March. They put a gate between my kitchen wall and the neighbours garage, about 4 foot wide.
    Then I had the neighbour complaining to me that I should have asked permission - even though the gate was up before I even viewed the property!
    I suspect it has been overlooked and it should be there.
