employment agency problem

I recently started work for an employment agency on a construction site. After doing 60 hours, and with payday on the horizon they suddenly want a lot of identification that i do not possess. They didn't inform me of this requirement before i started working and now they are refusing to pay me. Is this right and if not whats my best course of action? I'm literally pulling my hair out....

    You have to have proof to work in this country or they can not employee you let alone pay you.

    When I have signed with an agency they always ask for the ID when I have signed with them. Strange OP that your agency haven't asked you. Surely you have something with a NI number and birth certificate.
  • They have requested a passport/driving licence. I have sent them proof of national insurance number as i have been paid using just that information before.

    I have always had to provide proof of NI number - being an oldie I've always given them an old pay slip. Also, I am always asked for photographic ID as well.

    They may well have broken several rules in relation to letting you work before getting this info - I'm sure there will be someone on here who can clarify.

    I would suggest if you don't have a DL or passport then you send them something photographic confirming your ID if you have it.

    Then they are idiots. A driving licence does not demonstrate the right to live and work in the UK - it demonstrates the right to drive in the UK! A NINO alone is also not sufficient as documents may not be yours. The list of acceptable documents is here: http://listers.co.uk/Careers/Proof

    I doubt they want the licence to prove they can live and work in the UK. It's photographic ID (as is a passport), which has your details on and proves you are who you say you are. It's not the only document they want judging by the OP, it's just that's the document which they've requested that the OP doesn't have.

    A lot of agencies usually want ID and your national insurance number when you sign up with them so they know you are who you say you are.

    In my experience, asking for photographic ID (with other documents) is expected.

    Just to point out no employer or agency can check who you are with an NI number alone as they have no access to anything to check this.

    It does. But at no point have they said they've given anything other than their National Insurance number. They may have, but they haven't said so.

    I wouldn't class either driving licence or passport as a lot of information so I'm guessing they've asked for other documents as well and possibly been given them, although the OP would suggest not.

    So I'd say that they have the NI number, the OP may or may not have proof of living and being able to work in the UK and they may or may not have given them that proof, but either way the OP has been asked to give photographic ID which they don't seem to have and until they get it they don't know that the OP is who they say and therefore won't pay them.

    Regardless of the rest and whether or not the agency should have such documents, the company doesn't have that and wants it so the OP needs to find a way to get one of them (or some other acceptable form of photographic ID).
