    Thanks all for Your replies. Now.....any idea of holiday pay, as the boss is trying to get out of paying us anything at all. what way does itwork ? are there different ways of working it ? said "No redundancy" but would pay us holiday pay IF ( puhleese ) we were entitled. The boys have contacted the Union and told him by law he has to pay us or if he declares bankruptcy we can get it from government ? ( is this correct ? ) so we must wait til friday to see what happens.

    But, as I said earlier, no harm in talking to your colleagues and banding together to make sure you get, as a minimum, what you are entitled to.

    Divide and conquer is often a technique used, but bosses who wish to get away with as much as possible.

    Not all employers so I am not having a go at everyone, but I have seen it done.

    You have got our boss down to a fine tee, he dont want to part with anything. all he can think about is himself, regardless of the people loosing their jobs.......
    He said he would get a friend to offer us all a job and then he wouldnt have to give us redundancy. is he correct ?

    Hi there

    Yes you are entitled to payment in lieu of accrued but untaken holiday pay at the date of your leaving i.e. if you have accrued 5 days until your last day but have taken 2 of those on holiday you are still entitled to payment for 3.

    If the employer goes under you can claim from the government - notice, holiday and SRP. You would have to go through the Redundancy Payments Office - check out the Dti website.

    He theoretically could have some of the workforce transferred to another company, i.e. taken over. But they would be protected by certain rights and the job would have to be the same or very similar on the same conditions.

    Remember it is positions that are made redundant not people.

    For example if a company finds it only needs 3 sales people instead of 5 then two posts must be made redundant. A process of selection then needs to be gone through to select those for retention. The company cannot decide the next week that it now needs 5 again and hire another two, different people.

    A bit simplistic but that is sort of the basics.

    I take it from your OP that the whole business is closing down?

    Yes the company is closing. and just an update we have been told today we rare getting our redundancy tomorrow.so looking good so far

    I read in a previous post on here that Redundancy pay is not taxable. say my pay was £250 per week gross there is roughly £28.50 tax and £16.50 nat insurance. say i get 8 weeks pay is it 8 weeks at £250 or what ? just want to check what they give me today is correct before leaving.

    Redundancy pay of £30k or less is tax free.
