As I mentioned in a previous thread, I have several debts that aren't mine on my credit file with defaults. the name a DOB are slightly different and i've gone through the process of fighting to get them removed.
Once removed though, can the companies continue to add to MY report in the future about these debts? I am applying for a mortgage next year and I am terrified that if this person is issued with a ccj, it will affect me again???

I doubt they'd be prevented from adding to your report again, BUT, somebody has made a mistake in adding to your report in the first place. You can only hope the same mistake won't be made again.
You should have no problem in getting the inaccuracies removed, it just takes time.
Check all three credit reports in advance of applying for any mortgages.What will your verse be?

wow, that really sucks. I dread the idea of having to go through this every 6 months or so. You would think if the credit ref agencies removed it, it would stop the same people/companies wrecking my report again ?!

Try not to let it stress you out because it WILL be removed - it's just a matter of WHEN.
You're not applying for a mortgage until next year, so there's no immediate need for the info to be removed, although clearly you'd like it to be.
It's unlikely to happen a second time I think.What will your verse be?

Well, just spoken with equifax and experian and they just told me that unless these companies /lenders agree to remove this from my file, they won't !!!!! I argued that its their job to ensure that the info was accurate and that they can't allow it to remain if its not right, but they said they can't. Just feel frustrated to hell with it all. I've provided copies of my passport etc and put in writing that I don't know this person and haven't taken these accounts out. In the event that they refuse, what's my next step? I'm desperate to sort it out either way. Surely they can't keep these defaulted accounts on there because the name / DOB is similar??0

Formal complaint to the CRO's then to the information commissioner's office.

Thank you. I'm so hoping that it won't come to that. Why would a company risk insisting a debt is mine when the name and dob are different though? It's just not right :-(0

I would suggest the beef here is with the CRA's as they are linking someone with the wrong date of birth to your credit record.0

Write to them asking them which law says that they have to put on your file what they're told.
Section 14(1) of the Data Protection Act gives a court the power to order a data controller to remove or rectify incorrect information.

You could threaten to take them to court but they probably get that a lot.
I think you'd be better off focusing on the individual companies than the CRA's, as they will just stonewall you with their crap standard response like you've already had.

I would image the lenders will agree, wait to see the outcome of the dispute first, disputes take time, if you don't get the result you want then take it further. I can't imagine the data remaining.0
