dress refund

Hi I was wondering if anyone can help.
I brought a dress for a wedding on the 17thAugust 2013 from Zara I noticed at the time a couple of the other dress hadslightly split at the bottom of where the zip was attached to the dress but theone I brought wasn’t. I wore the dress for a wedding on Bank holiday Sunday andafter about an hour of wearing it my dress had exactly the same split in it(very embarrassing), to be honest it didn’t feel particularly tight on me. If Iwent back to the shop do you think I would be able to get a refund?
I was thinking of seeing if they had the dress still instock if any of theirs had any faults in. To be honest I could probably fix iteasily however it was £40 and I shouldn’t have to.

As you've worn the dress I don't think you'd get a refund unless you convinced the shop assistant that you hadn't! This is dishonest though and I wouldn't try it. the shop may offer a credit note as a goodwill gesture. I would just repair the dress myself- less hassle - but £40 is quite cheap for a dress, you get what you pay for.0 -
It is faulty. Op can get a repair, refund or exchange. Worn or not.
A dress shouldn't split at the zip unless you've gone in a dress to small.
Probably an inherent fault seen as what you've said about others.0 -
I'm sure if the store won't give you a refund you will definitely get a response from Head Office. You buy an item of clothing that you assume will last a certain amount of time. It has developed a fault after not even one wear which is just not good enough. I think it would be really harsh of them to say no to a refund unless you've torn it yourself.
I know I had a coat from New Look a couple of years ago which tore at the seams a bit too easily - I didn't tear it myself but I think the seams weren't finished off properly. If the dress is inherently faulty and the fault wasn't caused by misuse or reasonable wear and tear then you are entitled to a refund, repair or replacement. If you are deemed to have accepted the dress (and by wearing it to the wedding you probably are) then the retailer gets to pick whichever option is cheapest for them unless it causes you significant inconvenience.0
