appeals

I passed the assesment for esa and was placed in the wrag group.Last week attended an interview at job centre for work programme,after speaking with company who run the group he said, if i was that bad i should consider appealing. I have been debating this. Can you tell me if i do go ahead with an appeal do you get put on assesment rate of £71 or do you stay on your current amount. Thankyou

    You would stay on the same amount as now. It can take many months for an appeal.
    Lost my soulmate so life is empty.

    Thankyou very very much. Yeah I had heard it can take time. I had been told youd drop to £71 so needed it confirming before I go ahead. Thanks again :)

    It drops if you had failed to get ESA at all but as you got into the WRAG that won't happen.

    Thankyou once again its a big help as when your on your own it makes things tougher. I will ring them tomorrow and get the forms to appeal :)

    It is important to understand that being 'that bad' is not a ground for being in the support group.

    You need to either:
    Be terminally ill.
    Have certain communicable diseases.
    Not be able to perform one of the activities outlined in the descriptors for the support group.
    Be put at risk by being found to be in the work-related group.

    In addition, if you were placed in the work-related group over 13 months ago, you cannot simply appeal this decision.

    The relevant descriptors 'limited capability for work related activity' are on page 25 of http://www.direct.gov.uk/prod_consum_dg/groups/dg_digitalassets/@dg/@en/@disabled/documents/digitalasset/dg_177366.pdf which outlines how ESA works.

    You need to meet one or more of these (or one of the other circumstances) in order to be eligible for the support group.

    I certainly do fit several of them. Dont really want to go into too much detail on here but Iam very grateful for the help :) I was placed in esa wrag group in april and am awaiting the decision from a 3 month review,which in itself is ridiculous.
