  • Cafcbrown : You don't say when the PCN was issued however whatyou should be made aware of is that the landowner of the carpark used to be Dickensworld on 8th June 2013 they land ownership changed to Dockside retail park. I have been informed by both Dockside retail park and Dickensworld that when the land ownership was transferred over on 8th June 2013 UK CPS were not longer allowed , permitted authority or had any further association with the landowner. If your ticket was issued after this time then UKCPS have no legal validity to their claim and this is simply a false claim to line their own pockets. Let me know if you fall into the category of having UKCPS fruadulently ask for money which is not legally theirs without permission of the landowner since I am compiling a list of people issued and chased up on these since such date as their claims are fraudulent and liable for criminal charges. I hope this helps

    Sorry, but a new poster pretending to be helpful and asking for details that might identify a poster bears all the hallmarks of a PPC Shill.

    So OP, be very careful about giving any info to this poster that might help them identify you and anon1238, if you are genuinely looking to help people, why not contact one of the main people on this forum so you can be verified and endorsed!

    My intentions were to help cafcbrown and the information about the landownership is 100% correct.

    yes I do have a solicitor involved, to process my counterclaim and there is no obligation for anyone to provide info but I do feel that there is greater weight in numbers as its easier to bring a class action if you can prove that this firm is fraudulently claiming from a number of victims since they do not have permission after 8th June.

    What CAFCBROWN needs to know is that the claim against her isn't valid if issued after 8th June.

    Thank you for providing the information about the change of landowner. That is useful, and something that OP can investigate further for herself.

    However, as far as a class action involving the use of solicitors is concerned - I admire your determination but the costs of legal representation is going to far far outweigh any financial benefit that might be gained by any individuals who choose to sign up to it. Particularly since it is possible to see off the charge for free by mounting a forum supported appeal to POPLA.

    I also second Pogofish's advice to forum users not to give out personal details to other posters. Not only is it against forum rules, but in reality, you really have no idea who you are giving those details to.

    Yes, you are right we don't practice class action in the same way as the US.

    Here 'class action' is shorthand for a group of people with the same claim getting together and choosing one of them who has a good case to run a claim, on the basis that if it loses they will appeal and that will set a precedent, and if they win the others waiting in the wings will use the same solicitor and keep fielding winning cases with a high possibility that the defendant will just pay up. But these cases are normally funded by trade unions, national charities, or legal aid (when there was such a thing).

    There is also the potential for a scam where all the people involved chip in with their financial contribution to fund the 'lead' person's claim, at which point the lead person disappears with the money (not that I am suggesting any such thing here).

    Whan you say you won your case. Was this a POPLA appeal, or did it actually go to court? If so, were UKCPS suing you, or was it the other way around?
