  • I've noticed that the "offence" occurred on 2nd May and the date of issue of the original letter is 21st May...is this information of any use or is it too late to use....any further help would be appreciated as the wife is getting jittery and is thinking about paying the charge which is now £128 along with the threat of a further £207 costs should it go further .... I look forward to a response (however harsh)....

Yes, that was the point I was making. The late Notice to Keeper(OWNER)?? and all the other flaws with the Notice if you research it a bit, is why you can use Broadsword's letters to APCOA, the BPA and the DVLA.

Look at this response for APCOA that a newbie wrote, shows the sort of thing that can be wrong with APCOA's notice:

BUT you really need to read up on it more and then start your own thread please as this is someone else's case.

Just a 'heads up' GPB act for Roxburghe who are debt collectors and do not have legal standing to take anyone to court.

But GPB are sneaky, and they have also started acting for APCOA - who CAN take you to court.

So please don't get complacent - do check the letters and if you get a letter from GPB stating that they are writing on behalf of their client APCOA please DON'T ignore it, especially if it is headed 'Letter before Claim' (or words to that effect) as that is the first step on the formal court process.

In that case enter LBCCC or LBA into the search box and follow the instructions to make use of the Practice Direction, to (hopefully) avoid court action.

I'm a retired employment solicitor. Hopefully some of my comments might be useful, but they are only my opinion and not intended as legal advice.
  • What GPB do is they state on the letter headed paper (which is sent out from roxburghes address) that they act on behalf of APCOA but that is rubbish....because the matter has been passed to them by Roxburghe who have additionally added on their slice of charge, and given they are both at the same address, Roxburghe are GPB's client and no body else......dont be fooled......:T
  • Great thread, everybody. Thanks all around. (Also fighting this ludicrous Luton thing).
