House seller lied to solicitor

  • A local authority search is a standard part of the conveyancing process and would have revealed any local planning applications.

    No they don't - they only reveal planning decisions in relation to the property being searched against. That's the reason for doing an additional "Plans Search" to seek to get further info about local decisions. (Some councils are lazy and to keep their admin down will give you all the decisions in a given road - but that's their own internal admin decision and they have no obligation to do this.)

    If pp was sought then seller should have been notified and therefore should have revealed it to his solicitors. So you might be able to sue the seller for negligent misrepresentation - but as others have said - quite expensive and stressful to do this.

    As part of cost-cutting many councils don't do the amount of neighbour informing on planning applications that they used to do. There has never been uniformity on this anyway.

    Our council used to put up planning notices, but when I applied for PP this year, I was sent a notice and asked to display it prominently for 28 days . It wasn't laminated, and without protection, its life would have been hours, not days

    No neighbours were informed, but the local grape vine covers that stuff anyway. ;)

    Even if the council sent a circular to inform all neighbours ( which doesn't happen everywhere) who honestly reads things entitled dear owner/ householder ? I don't I assume they are a circular and bin them unopened..

    Not being funny but if I was building an extension I would be talking to my neighbours before planning went in.

    Not being funny either, but that depends on the situation, surely?

    One of my two immediate neighbours is some distance away and rents.

    The other one is a horse. :)
