Of course they can, ops exchanging it for a more expensive piece, thus pays the difference. Nothing it the option of 'exchanging' goods is it implied no extra charge will be due.
I wasn't changing it for a more expensive piece - it was the same just in a different size. I do agree that they can probably charge the extra though since what they're doing is beyond what they have to do with respect to consumer rights.
With regards to returning without a reciept - the store in question would only refund the current price, so yes if it had gone down in the sale that is what you'd get. In this case though it hadn't.0 -

Technically it was a more expensive piece.. The item you bought was worth £x, the item you want now is worth £y.0 -

Ah, well in that case of course they can. It's a different item as you said. The only time this would be debatable is if the OP was trying to exchange to the same size if there was a defect. SOGA would kick in there (although the shop would probably be entitled to give a full refund of the sale price rather than exchange)One important thing to remember is that when you get to the end of this sentence, you'll realise it's just my sig.0
