Will I come under Scottish or English funding?

I was planning on starting an HND course this year (2 years) but the Uni is now no longer running the course as they could not fill enough places. I am therefore going to hold out in the hope they will run it next year.
I've lived back in Scotland since mid July 2012 so I will have been here 2 years when the course starts next September. Does anyone know if I will come under the English or Scottish rules for funding?
In terms of my current application which is now not going forward, I was assessed as coming under the English rules as I had only been back in Scotland for a year. I think they look at where you have been resident for the last 3 years so is there a chance I would now come under the Scottish rules next year? I am paying my own fees for one of the two years, so it will make a difference how much they want me to pay!

Thanks for your reply. Unfortunately I'm not sure it's as simple as that, I have already been through the process with this year's application and was informed I would come under English rules (SFE) even though SAAS seemed willing to fund me too.0
