  • Unfortunately young drivers get scared easily. I will 'soft' appeal this letter and ask for a POPLA code and see what happens then I suppose :(

    Soft? Sadly they have your DD marked as a 'soft touch' now and you will get the usual template reply with no POPLA code; the one you will find in all its glory if you Google the phrase 'UKCPS address the factual issues'. Try that Google search now - and this time when the scam pans out exactly as we are telling you it will, please advise your DD to be proactive, not a con-victim this time, and follow it up with another letter demanding the POPLA code. None of the threads you will read when you search that phrase from their template letter will show a person who has paid...no-one here does that...very sad to read this from a young person just starting out who needs to learn about scams and cons and how not to send money to protection racketeers.

    Paying it was exactly like sending money to a phishing emailer and not the right move at all...did she not realise it has no effect on credit rating and wasn't a fine? And they don't go to court at all when you beat a PPC at POPLA - as we help people to do 100% of the time on here since Easter. Like most regular MSEers, I wouldn't have let my daughter pay this and have educated my niece on the scam (a young driver with a disability who has received about 6 fake PCNs for 'overstaying' - none of which has she ever paid of course). What a shame to read the one in a thousand threads on here where someone actually PAID even after getting advice.

    The bunch of shysters your DD sent money to, apparently operate out of a caravan round the back of a pub. If you want to write to them directly the real address is allegedly/possibly:

    ...as featured on a daytime TV programme a few months ago, 'The Sheriffs are coming' where they - UKCPS - were being pursued for a (real) court debt.

    Please take off those rose-coloured spectacles & do the Google search I suggested above to read what other people did to - very simply - beat this scam with just a POPLA appeal letter for each case. Easy when you know how - and you are here, we can tell you how.

  • Thank you. I have read the various letters and intend to get her to write something in response to the demand for payment of the 8th August one. She has gone back to take her own photographic evidence and says there is no signage leading up to or in the vicinity of where she parked. I will take pointers from the other posts and let you know what happens. Thanks again
  • I intend to send the following in response to the NtK. Any advice would be most welcome. Thank you.

    I write as the registered keeper of vehicle ****** afterreceiving your notice to keeper letter dated 11 September 2013 referring to aParking Charge Notice (PCN) of 8/8/13 which you state was fixed to the car inquestion.

    The driver of the vehicle at the time asserts that no PCN wasreceived by them either on or around the car on that date and they aresurprised to see the Notice to Keeper letter.

    The amount charged in the Notice to keeper is punitive andtherefore unenforceable as it does not show in detail the losses you assert foruse of the land for parking.

    Please send the name of the landowner so I may send a copyof this letter to them

    You assert that a contract was entered into by parking atthis specific point. The driver assertsthat there was no signage leading up to or where they were parked. Please provide evidence (along with drawingsthat pinpoint the alleged signage) of this signage and prove that is clear toanyone from within a vehicle at 30mph.

    If you disagree with the challenge above please send a POPLAcode by return. If I do not hear fromyou with the POPLA code I deem you to have acceptedthis challenge and the matter is now closed

    Just add in your final paragraph 'within 35 days' (which is the prescribed time for a response - well almost, it certainly was before PE and the BPA started !!!!!!! about with it - but stick it there anyway, it will perhaps help focus their minds).
    Please note, we are not a legal advice forum. I personally don't get involved in critiquing court case Defences/Witness Statements, so unable to help on that front. Please don't ask. .

  • Hello once again. Thank you all very much for your sound advice and here is the situation since I posted the letter in response to the NtK letters;

    PCN issued for 12 August has been cancelled following my appeal as per my previous post (This NtK was received about 5 days after the one for 8 August):j

    but PCN issued for 8 August received the usual drivel allowing me another 14 days to pay the initial charge:

    "Whilst we sympathise with your situation, you were correctly issued with a parking charge. The charge will remain on hold for a further 14 days from the dated of this letter." letter is dated 26 Sept.

    The letter ends with "You may also appeal to an independent assessor through POPLA details of which will be sent at the appropriate time if requested."

    It also enclosed photos of the car with a PCN stuck to it but no photo of where the car actually was. In fact it was parked in exactly the same place as the PCN for 12 August!

    Ummm my original appeal stated very clearly that I wanted a POPLA code so what do I do now? Reply that I asked for a POPLA code and since they did not give me one in their rebuttal of my appeal and that the car was parked in exactly the same place as the later PCN I deem the PCN revoked?

    Any help would be most appreciated. Thanks

    You'd be best reading other UKCPS threads to learn what others have done (this is a standard tactic by UKCPS to delay giving a POPLA code). So it's time again to Google 'UKCPS address the factual issues' as I mentioned before. That gets you all the recent UKCPS letters talked about on here and on pepipoo and will answer most of your questions, since people have been there before you.

    Best advice, I say, is to write and say 'now is the appropriate time. Send the POPLA code or I will complain to the BPA and the DVLA about your delaying tactics'. Better than letting the POPLA chance slip.

  • Many thanks. I have read the various threads and your most helpful links. Am off to compose another letter demanding the POPLA code for the 8th August PCN. Will let you, and other members, know what happens.
  • I would be very grateful if someone could have a quick look at my second attempt to get POPLA details out of UKCPS. Below is what I have drafted:

    Thank you foryour letter dated 26 September which was received on 27th September. You state at the end of your letter thatan appeal can be made to POPLA and details will be sent at the appropriate timeif requested. In fact the first appealto you specifically stated that POPLA details were required and your rebuttalof the appeal was the “appropriate time” to issue these details.

    Your failure toadhere to the BPA code of practice which states:

    22.12 If youreject a challenge you must:

    • tell the driverhow to make an appeal to POPLA. This includes providing a template ‘notice ofappeal’ form, or a link to the appropriate website for lodging an appeal

    will be one of thepoints raised on appeal to POPLA. As youdid not provide the POPLA details according to the original request you alsoagreed with the points raised and therefore accepted that the matter was closed.

    Please ensurethat the above referenced PCN is cancelled forthwith.

    Once again if youdisagree with this letter please ensure all points in the original letter dated16 September are answered and provide POPLA details within 14 days of the dateof this letter
