Where do I stand with recent new car purchase?

Hi all,

On the 10th of August I bought a 58 plate Jeep from a garage 35 mile away from me.
The car had seemed fine on the test drive and all the finance checks etc came back fine.
When driving it home I struggled to get the car up to 70mph and it didn't seem to accelerate past 60mph.
As this was my first Jeep I presumed it was due to it being shaped like a brick, combined with me maybe changing gear too early.

A couple of days later the engine management light came on and the error related to a turbo overboost.
I done some online research and found that it was most likely due to the turbo vanes being clogged.
I spoke to the garage and he stated he would get it in to a local garage to him the following week.
I obtained a quote from a local VW specialist (it's a VW engine) and advised the garage, he was happy with this and said if they contacted him after completing the work he would pay over the phone.

Following the completion of the work the VW specialist called me and said that it sounded like the bearing were going in one of the rear wheels and not to drive long distances on it.
I asked him to notify the garage when they called to take payment for cleaning the turbo.
I then emailed the garage the same day (Friday) and got no reply.
I text him yesterday and got no reply.
Today I used the car and the although the turbo is a hell of a lot better, it did go limp again towards the end of my journey.

We would be happy with the car working as it should and are not sure where we stand.
We part ex'd our old car and paid the difference via cashback credit card.
Can I reject the car? - and if so would that mean we would have to have the original car back and the cash?
Due to how dangerous driving with bad bearings could be, would I stand a chance of getting the money back if I got the work done and then sent him the receipts?

Any guidance would be appreciated.

Your trade-in complicates things considerably as if it has already been disposed of you cannot expect its return.

The dealer may honestly not have known of the bearing issue, so rather than hit him with a demand, state that an additional issue has come to light, and he may want to look at it again.

    Ignoring the bearing for now.

The original issue is still there right? So the dealer has agreed to fix this but the garage you selected has not been able to do so? Presumably the dealer you bought the car from paid the other garage, so you first port of call should be back to your 'specialist'.

And why text - you have the phone in your hand, speak!!!!

Absolutely agreed with john_white ; get on the phone and talk to the garage who sold the car
  • Thanks for the prompt responses.
I got on the phone today and the dealer initially agreed to pay for the repair.
I have since had an email from him saying that he is unhappy with this and that he has repaired my car without complaint but the cost to repair the window on the part ex I put in is more than expected.
I made him aware of the window before we part exchanged.
