how do I get my money back?

Hi, I recently sold an item on ebay, the buyer messaged saying it wasnt working properly so was returning it with collect+, they delivered it to a "secure place", my front garden! if they delivered it at all, anyway it is trackable but I never got it so it was either stolen from my garden or not delivered, the buyer has got their money back through paypal who hate sellers and I have spoken to collect plus who said they only refund the sender, I know my buyer has been in contact with them so will prob claim from them and get double bubble. Meanwhile who do I get my money back from? technically the drill is mine now he has been refunded so collect plus have lost my drill, any ideas?

    Firstly this would probably have been better on the ebay board.

    You are in a difficult situation here, there is nothing you can do now via ebay or paypal as all they require the buyer to do is show that item has been returned, or an attempted return has been made. The buyer may or may not assist you further in a dispute with Collect+, that probably depends on how well you handled the return in the first place.

    Colelct Plus should be able to discuss this with you, although as they say any refund would go back to the person who they are in contract with- ie the buyer.

    You will need to get your buyer onside with this to sort it out but meanwhile you still have legal options against Collect + if the drill is worth that much and assuming buyer paid for the correct amount of insurance. It may well be worth approachign Collect + on facebook as social media seems to be one way these companies respond.

    update to the original post, after a bit of back and forth collect plus agreed to refund me for the drill their driver has stolen however I have just got in and noticed an email from them offering a refund but it is less than half the price of the item, I am sick of all this and have already got my N1 form for a small claims and will persue it to the end, just a warning to anyone out there thinking of using collect+ not only do they steal parcels and lie about where they leave them they then try to rip you off when by part refunding you.

    Well, as Soolin says, if the correct insurance wasn't purchased by the buyer...

    Or perhaps it was... you haven't said.

    I dont know what insurance they took out, that is irrelevant when the courier steals you parcel dont you think? Collect plus seem to make a habit out of this.

    Would a small claim against them work? You have no contract with them so they don't owe you anything. You would have to claim against the buyer I would have thought.

    It doesn't matter that the drill is now yours, you didn't have a contract with Collect+ to sue them for breach of. The only thing you can take them to court for is alleged theft, but you have zero proof of this.

    If your buyer has had the refund from collect+ but not passed it on to you, it is them you should be taking to court.

    If you have evidence of the driver stealing the drill surely you should report this to the police as it is a criminal matter. You do have evidence of this don't you?

    Also, how do you price a faulty drill?

    The responsibility for the drill remains with the buyer until it is delivered to you.

    The buyer should be making a claim with collect+ for the value of the property they have lost.
