Man and wife both sick...failed medical...help?

    It is the OP (see post 1 ) who has a sister with the condition.
  • I am interested to hear that they are high up the list for a transplant. My sisters health worker says this isn't the case as it does not cure and only prolongs life therefore they are significantly low down the list. The work terminal to me is a disease that will eventually kill you. It will definitely eventually kill my sister and cannot be cured. X

    I assume the assessment looked at what your sister can do now, not in 2 years time. If she is stabilised enough currently, then that might be why they consider her fit for work. That doesn't mean that in 3 months time, she might be back in hospital and a review then would consider her unfit for work.

    If he used to get Incapacity Benefit.... did he have a medical for ESA and fail it?
    Why did the IB end? Does he get ESA Contribution based now? Or ESA NI credits?

    If she is claiming ESA for both of them, then he cannot claim ESA (for both) unless she closes her ESA claim(for both), she can keep her appeal open and he will need sick notes from a doctor for the new claim.

    But if he failed an ESA medical or had an ESA claim (in his name) closed in the last 6 months then he may not get paid on his new ESA claim.


    As she gets high rate DLA care, *he* can claim Carers Allowance to care for her... if he already claims Carers Allowance he can claim Income Support for both of them (but she has to close her ESA IR claim for both of them)

    If he claims CA & IS they will be on more money than if she was successful on her ESA claim and got into the Support Group (the highest group on ESA) It would be better for them to stop the ESA and claim CA & IS instead.

    If she has no other benefits that will pay her National Insurance Credits, she can keep her ESA open for NI credits only, while the appeal goes through and whilst he is claiming CA & IS.
