What premiums should I have got when on Income support whilst getting middle rate care and low mobilty? With knowbody getting Carer's Allowance.
The DWP are saying I am not entitled to the severe disability premium as my partner was not getting DLA.
I wrote to the DWP with dates etc and the write back blacking the request for back dated payments. They basically wrote back on the basis of the DLA decision before the tribunal.:mad::mad:

unless both parties receive middle rate care DLA, then a couple living together will NOT receive the severe disability premium, so they are correct in waiting for a DLA decision for your partner0

I was under the impression if knowbody is getting carer's allowance and the person gets at least middle rate care. Then severe disability prem would be applicable. I know on ESA I would not get but I thought I read we could get the severe disability as I was getting middle care with nobody getting carer's allowance.

That only applies if you live alone (or the other person is also in receipt of MRC). In your situation you would just get the disability premium.0 -
In regards to ESA: We have a joint ESA application in the support group. My partner has claimed Carer's Allowance will the ESA Carer's Premium be paid?0

do you both get mrc?or just one of you?
if only one then the other can claim CA and get the premium,if both get mrc then both can claim CA (in most cases)and therefore get two premiums0 -

You should be getting Couple Rate Disability Premium, this is awarded to any couple if there is DLA on the claim....
You cant get SDP at the moment because your partner has no DLA, but if he is awarded middle rate care or above you may get couple rate SDP.
Why is he not claiming CA for you ????0
