    The legal standpoint is that the arisings do belong to the person whose land the tree is on.

    Legally you are allowed to cut back another persons foliage to the boundary because it is causing a trespass.

    Cy is correct if you do cut it back it needs to be offered to the owner but he does not have to acept it in which case it is the responsibility of the person doing the cutting to dispose of it. Just dumping it over the fence is not an option.

    Of course the way forward is to discuss before cutting. That way everybody is happy.
