Random question, but if the pattern used is not the one you were sent, where did you see this pattern (in the shop?) and are you basically saying that you ordered worktop XXXXX and were sent YXXXY? And that they can no longer supply you with XXXXX?
I had contacted the laminate manufacturer separately and requested a sample of the laminate. They only supply the laminate so to get the worktop I had to order through a fabricator. Once the mistake was identified (post delivery) the fabricator have told me their machines don't work with the laminate I actually wanted.

I agree entirely. I think the boss is still unaware and they're trying to hide it hoping it won't get to him/her.

I am really sorry but I have never ever had to even file a MCOL; the page I linked to has lots of details.
Hopefully someone who has has experience can come in and help you now.
What I would say is retain copies of the forms you file and the paperwork you send if you do decide to file. Please be aware that you are not guaranteed to win; this is why you need as much evidence as possible and make sure you read all the information before filing the claim. The process has been designed to be simple enough for non-legally trained people to use, so it shouldn't be too daunting.
But either you give up now and lose what you have paid thus far or you do decide to fight; this will cost at least a further £25 (I think...) If you do win then they still may resist paying up (as I understand it) and you may need to instruct bailiffs at an additional cost. Please bear in mind though I have no personal experience of this; it's just theoretical.

thank you for such kind words. I'm actually surprised how calm I'm staying in the circumstances.
I had a bit of a wobble last night reading how much the costs can be so I called the CAB this afternoon. They were FABULOUS, I really can't find a word for how professional and lovely they were. We ran through everything and she told me what to do next (a final letter as there was one thing I hadn't got in my original letter clearly enough) stating that I will commence court action if no resolution in 10 days.
I feel much more confident now. I didn't realise how much a knock-back from them would knock my confidence. I thought that if I wrote it down clearly and showed that I was within my rights they'd see sense. I know I'm a bit naive but it always surprises me when people are deliberatle not nice.
I guess it will come to court action now (or at least doing the forms so they can settle the day before just as I'm going into labour or something like that), but I'm glad I've had the advice from CAB and here and it's given me confidence I'm not losing my mind.29/01/07 - Took on our first home for £225k, mortgage of £200,700, reduced to £70,224.44 in 6yrs
