Galaxy s4 broken, who has to fix it

Hey everyone,
I bought a Samsung Galaxy s4 in May 2013 from EE over the phone and it was an upgrade so I guess I pay by Debit card.
After 12 Days I noticed a crack on the screen. There was nothing on the surface of the phone itself but you could see a slight crack. It is difficult to describe but the best way is that there is a scratch on where the pixels are of the phone. It had not been dropped and I assure you I took the utmost care with it. I had it in a leather case with a hard shell, and it had an extra screen protector on. It has now been months and EE have told me its not their problem, so have Samsung.
I just want it fixed

The problem you have is proving it, screens don't just break for no reason and as it wasn't broken for the first 12 days you had it something must have caused it to break.
Sometimes it can be down to poor design but it would then be a common fault with lots of screens broken in the same area.
If you have the phone or if you can get it back you can get an independent engineers report done, you have to pay for this. If it finds the fault is yours then there is nothing more you can do except claim off your contents insurance or gadget insurance with your bank.
If the report finds the broken screen to be a fault then you can sue EE for it, however you will have your report going against theirs so you still might not win if the judge believes standings report over your report.
ETA: you could buy a new screen off eBay and watch a YouTube video on how to change the screen yourself and fix it that way0
