    Thanks. To be honest, that's kind of inline with what I was thinking, at least for now.

    I'll report back with anything that happens in case this can help anyone in a similar position in the future.

  • Judgment has been entered against you, but this is not a default judgment. It is what is known as interlocutory judgment. So there would not be an adverse record on your credit file.

    Essentially the other side have issued for a non-specific amount and there has been no contest to the actual claim filed, so the court have noted there is no dispute as to what causes the claim to arise, it is now the job of the court to decide how much the other party and their solicitors will receive.

    Your insurers need their heads jumping on for not getting their appointed solicitors to file a notice of acting and acknowledgement of service in time.

    Unless you were intending to dispute fault for the collision, there is no real prejudice to your situation here, but your insurers and their panel solicitors need to get their act together a bit more.

    I've just spoken to my insurance company. It turns out that the other person's solicitor sent the original documents to the wrong insurer. Then when my insurer got in touch to ask them to send again, they haven't bothered to do it and have issued court proceedings - which my insurer does have a copy of.

    I've been assure again that I've done everything correctly, so now my insurance company is in the process of contacting the other person's solicitor to find out what is happening.

    Bit of a mess!
