Almost There - Credit File but Advice Required

Hi Everyone,

Long time looking, first time poster.. ;)

I've had lots of valuable information from this site and I'm a bit of a Credit File geek now, I'd say I'm a little obsessed to be fair... :D

Situation is I've got 9 days remaining until my last default is cleared on my file, plus I've got 2 CCJ's outstanding.. One is due to clear off my file in May 2014 and the other in September 2014.

I am ready to remove the default from my file in 9 days as it's aged and should be removed (6 years) so no real issue there.

The CCJ in May 2014 has now gone from my credit file as it's over 6 years old and the other CCJ (September) is fully paid up but this was only paid last year, can I get this one removed or marked as satisfied? I have a solicitors letter stating that it's been paid.

I've been paying everything I have, i.e. couple of Credit Cards (Vanquis/Aqua to rebuild credit) in full each month for the last 16 months as I've had them that long, and my other credit file items are all green with no missed payments for the last 5+ years.

How long will it take for my credit score to improve on the facts gievn above? I'm not expecting it to jump to 800+ (Experian) overnight once the CCJ's are gone but that would be nice!! :rotfl:

One final thing is a CC default that went off my file some time ago (approximately 6-7 months) as it had aged over the 6 years and I've just had a letter from Lowells stating that I now owe them the money? do I call them and tell them it's not valid and it's over 6 years old? a little confused on this one..

    Data drops off your credit report after six years for data protection reasons. That doesn't remove your liability for any debt that remains outstanding after that time, unless it becomes statute barred - which usually requires no acknowledgement of the debt for six years. These two things are not necessarily connected, but it is a little confusing.

    I take it you mean the CCJs expire in 2013 not 2014? Once the default and CCJs have all gone then your 'credit rating' should look much better, especially as you've taken sensible steps to build up some positive data. I've put credit rating in inverted commas because this will vary from lender to lender depending on their policies. The guide score you can get with your credit report is designed to help you understand how your credit report data might affect a typical lending decision. Lenders do look at a wider selection of data though, such as your income.

    You shouldn't have to do anything to remove it. Should come off automatically. Saying that, Equifax are pain and may need prodding.

    You mean 2013 surely?

    You can have it marked as satisfied if you like by applying to court with that solicitor's letter as proof.

    How lenders regard your report should change when they drop off, and be based on the info that is left.

    If it is 6 years or more since you last paid or acknowledged that in writing, then it would be statute barred.

    They can't put another default on. If they do, you can complain and get it removed.

    I hope this makes sense... as the defaulted file was removed in May/June time as it was over 6 years but the actual CCJ goes off in May 2014.

    If paid, and you have proof, then you can get is marked as settled until it drops off in 2014.

    Get in touch with the court.

    I'll certainly do that, I'm going to try and get the Northampton Court information... I'm struggling to find the correct info via google, I'll search here too...

  • I've sent them an email (as I'm working ATM) to see what the steps are to get things updated, I've also sent them all the information and covering solicitors letter showing the CCJ is settled (although I appreciate it won't come off the file until September 2014.

    I've printed the letter off, I'll send to the courts with a copy of my solicitors letter once I know the fee (£15?) required by the courts to process.
