  • I'm trying to get them removed. Can credit ref agencies refuse to remove them although the name and dob are different and I told them that they are not mine?
Hope it's sorted soon as I certainly don't need a ccj

If the name and dob are different to yours, then they should never have matched those defaults against your report in the first place. In those circumstances, it is the CRAs furk up, so they are obliged to remove it. Tell them that if they refuse you will take the matter to the ICO and FOS.

They ave to prove you are one and the same - it is to up to you to prove you didn't. You advise them of their error and give 28 days to remove. If they do not, you complain to the ICO that the data is false and the CRA are ignoring you.

If you have a little money, raise a SC against the CRA as this will give you more satisfaction.
