Gym Membership issue

Hi all
Hope this is the correct section to post this..
After over 10yrs of membership to a Bannatynnes Gym myself and my wife cancelled, under our original terms we gave a 1 month notice as the gym has become more and more run down in our opinion and not worth the £100 a month.
Soon as we gave notice by email we stopped using the facility. we then after about another month get a letter demanding one more months fees as it turns out although we gave a months notice it fell 2 days into the following months membership and they are demanding that extra month from us of £100 for the extra 2 days!
we ignored the first letter but we are getting follow up letters now hinting legal action if we dont pay up. Naturally we feel this is unfair especially after both being loyal customers for over 10 yrs and over £10,000 in gym fees in that time and all because it was 2 days under the months notice.
we are thinking to ask for a copy of our agreement with them as after over 10yrs they may not even have it..
any advice of this please ?

I fear your length of membership counts for nothing.
Since the, and others, recently agreed to "improve" things for members it is certainly worth pursuing with them, get their terms and conditions from them.

thanks for the reply, we where on a rolling contract so after the first completed year it was just a case of if we wanted to leave we just gave a months notice. we gave 2 days short of a months notice and never set foot in the gym from the day we sent the notice in...0

I suspect that you had to give a "calender month" notice.. i.e. a full month. As you gave less than the full month, it will be the full following month instead. This is common for gyms.
Although you didn't use the gym, as long as they didn't restrict access I would say they are in the right.0 -
You should always Serve any notice by post, E-mail does not yet count as a served document.
Write back and ask for.
"Proof of claim"
Dear whoever before I can consider your claim for a months membership fee I must request you supply proof of your claim.
Without any supporting evidence such as copies of signed contracts where these claimed conditions and terms are clearly implied I am unable to move forward with your claim.
I await your supporting evidence, yours - Do not give them a Signature they can use to reconstruct a document, print your name and mark an XBe happy...;)0 -
Thanks, thats what i think we will do. they did except the email as proof of cancelation but like i say there being funny over 2 days. i know pound for pound 2 days or 20 days is still the same but its the principle that has annoyed us after so many years with them and so much money they are treating us so badly now. the condition of the gym is why we left, showers not working things hanging off walls constant issues with the air con and heating, freezing in winter and hot in summer year after year. The PH levels in the spar so far out it made your eyes sting if you went in it, and the general state of the place. So we just in the end decided to leave and go elsewhere and we are not the only long term members who have left due to the way the place has been allowed to become run down, not to mention a lot of the staff we got to know have left for the same reasons. we will see i guess..

Did you report the faults? If they were so bad, and you have evidence you reported them and they still did not repair, I would say that you would be in your rights to cancel anyway.0 -
we and lots of other folks used to always moan but face to face with the manager so no paper trail im afraid. ill send the letter as advised by spacey and see what they say..0
