I have recently gone back to work and been told we can not have help with nursery fees because we don't ge working tax credit but yet reading info it says if earn less than 40,000 we should get it please can some one help as we are struggling with fees

Childcare support is part of Working Tax Credit. So you need to meet the basic conditions of WTC to get it, but that doesn't mean you need to be receiving any WTC. Your income may be too high to get any.
However including the childcare costs can mean you end up entitled to more child tax credit or some working tax credit.
