  • If I am reading it correctly, UKCPS are urging the court to "strike out" the case, and just award it for the claimant! To have a court simply make a judgement against a defendant, and not allow them to turn up at court and make their case, is surely a gross abuse of the system. And, I presume, a judge would never do this.

    By all means, the court can strike out a case, but I don't think UKCPS realise this means they automatically lose.

    It is possible for the court to strike out a defence under CPR 3.4.

    I think I would be embarrassed to attend a court hearing after offering that pile of excrement for a judge to read!

    At least if you are going to try that approach let someone competent write the letter.

    When posting a parking issue on MSE do not reveal any information that may enable PPCs to identify you. They DO monitor the forum.
    We don't need the following to help you.
    Name, Address, PCN Number, Exact Date Of Incident, Date On Invoice, Reg Number, Vehicle Picture, The Time You Entered & Left Car Park, Or The Amount of Time You Overstayed.

    You would have thought they would have at least tried to cite the Equality Act 2010 (not 'the Equalities Act' which doesn't exist!).

    I have seen a UKCPS court statement once before and that same guy, Trevor Goodwood, called us 'forum gurus' then as well! I looked him up on Linked-in and laughed!

    The classic line he trotted out in a court paper was that us forum 'gurus' (well...me, probably, in his mind!) actually tell people to say they are disabled just because they wear spectacles or have a broken toenail!
