    The DLA application form seems quite clear

    Is there anything else you want to tell us to help us understand the help you need with walking outdoors?

    When the DWP conduct surveillance, they do it over a number of days, sometimes spread over a number of weeks, at different times of the day. They do this to refute any claims that a claimant was 'having a good day'

    They may also selectively edit the videos to support their case, without showing bad days. And may not present evidence of bad days.

    I have said that I have one good day a week - if they surveil me and see me outside doing stuff three times over a 3 week period, this is not inconsistent with my claim - yet may be presented as if it was.

    I do not say that it is the case that all surveillance operatives intend to mislead.

    As mentioned above - referring only to your worst day means that you have largely shot yourself in the foot.
    If you had been awarded based on a varying condition - though this is more difficult - you have a much better argument.

    Reporting only your bad days can amount to benefit fraud, and can lead to prosecution, and recovery of assets proceedings where they can do things that are normally impossible - such as selling your only house or car.

    Filling out the form as if every day was a bad day coupled with a chest infection so basically you're unable to do anything and rely on oxygen when in reality you're actually not bad most of the time but things can get hairy in winter is not "fraud" it's fraud, benefit fraud. If the DWP decide that you misrepresented your illness on your application form they can ask for every penny they've ever given you in DLA back.

    If you told the truth at the time and then got better but didn't inform them you should be able to prove by doctors letters or similar that the condition changed at x time and if they accept this they will bill you for overpaid DLA plus a fine for failing to report a change in your circumstances.

    Yes, you do state your worst days, but you must also state how often these generally occur, you must also state your usual days e.g. the condition that you are normally in.

    What level of DLA do you currently claim?

    Unfortunately I think you will find find that being able to go shopping and to work unassisted on a bus is a big flag that you may not eligible for DLA mobility.

  • not too long ago many "benefit" websites encouraged people to claim dla on the basis of your bad/worst days,it appears that those who took this incorrect advice are now paying the price
