Not working notice

Hello,

I am 19 years old and have been working full time for a year in a call centre. Over the weekend I made a last minute decision to go to uni in September.

I handed my notice in today, and was informed I actually need to give 30 days notice as oppose to 4 weeks that I thought - meaning my notice period runs out on 18/09 and I HAVE to be at uni on the 16/09 (though ideally 09/09).

My employers have told me they will absolutely not waive my notice. My question is what action can they realistically take against me if I skip the last 3 days? I'm really concerned about it and its taking away from my excitement of getting an opportunity I never thought I'd get!

    you have any holiday to take? If so ask to take as part of the notice

  • Likelyhood...not alot except no reference. Technically they can sue for breach of contract for any costs they incur but its unlikely (but not unheard of)

    Have you actually had written particulars?

    oh yes op if you haven't got all this in writing like a contract stating notice length then its only one week

    I asked about holiday and was told no.

    My team leader has gone to HR to get the exact dates. It's actually her manager that's said no - my TL has told me off the record that the only thing I can do is leave early, but she can't guarantee there won't be repercussions...

    I do have a contract which does state the notice period - there's really no way around it I'm going to be in breach of contact. I'm just trying to get some realistic expectations about whether ill get paid/deducted money etc. Most other info is for higher level jobs or leaving earlier.

    they can not short pay you - stop your money or not pay you holiday

    They could take you court for being in breach of the contract and claim any expenses you have caused them ie a temp to replace you etc

    they can stop the money...its just not lawful and the costs would only be the amount extra they are paying compared to what the OP would cost but cost of hiring the person etc.

    How likely is it that they would take that action? It's an entry level job but is a 4 week training course so they wouldn't replace me until they have enough new starters to train regardless of when I leave. It's a very very high turn around there, and most people leave in their 6 months probation which is only a weeks notice so they're prepared for people suddenly leaving.

    Did u sign anything regards to training costs and could this come to bite you?

    Only you can tell regards your employers, if they expect it I would guess they would pay you what you are due and leave it as it is but no guarantees.
