When a ATM expects to read a chip on a card. If it fails to read one. It will not allow cash to be dispensed.
Given that its not cost effective for the fraudsters to get cards with a chip and then program the chip.
It is far easier when they skim a device to send the details to countries that do not use chip & pin.

When I worked in a bank all cards that were retained by the machines were logged and the appropriate action taken, recorded against each card. If your card was shredded, this will be in the log along with the date it was destroyed and the name of the member(s) of staff - there should be 2. If the transactions on your account took place after that date your card could not be the one used.

Just an update...

I'm pleased to say that the bank in question have refunded the full amount pertaining to the unauthorised activity (both atm and shop transactions). I'd have loved to see the thieves in court, but very very happy to have my money back.
