Nexus 7 - Android 4.3 upgrade major crash - Question

I recently bought a Nexus 7 on the 7th August for many reasons, primarily because I am on holiday in a couple of weeks, needed something to entertain on the plane and be useful for writing.
It was running Android 4.2 and I erm'ed cautiously to upgrading to 4.3 because while looking for Bluetooth keyboards on google some news links came up about the incompatibility issues 4.3 had with bluetooth. However, my sister also had a Nexus with 4.3 and a keyboard that worked perfectly.
I decided to upgrade two days ago, but forgot to create a backup just in case. The upgrade seemed to work, I shut New to whole returning thing the tablet down. In the evening I went to put on the tablet again and it wouldn't turn on, I couldn't even get a google startup screen. I left it on charge while I slept and tried again in the morning. Still nothing happened.
I want to take it back to the shop as it seems faulty to me. My question is:
Am I allowed to ask for a replacement unit rather than a repair?
I don't mind taking a repair for an item that works for a few months, then breaks down. That would suggest a part going wrong. A tablet breaking down after a week I would be unsure of.
Is this ok?

Have you tried a hard reset?
You will lose your data, but you'll lose that anyway if you return the thing.0
