Parking Eye LBA

I've seen the various threads regarding PE and the LBAs they've been dishing out, I'm just wondering what I should do in my position.

I entered a service station complex back in June to top up with petrol and perform some routine maintenance (air/oil) and with it being quite busy this took around 15-20 minutes. I then drove to the carpark and spent around 1h 45 minutes in Starbucks and left.

2 weeks later I receive the first demand for payment for overstaying the free parking allowance by 11 minutes which I ignored after reading MSE's parking tickets appeal page.

4 weeks later the 2nd letter arrives informing me that the charge is now £100 and should be paid within 14 days, again ignored.

2 weeks on and I get the LBA. Is my above situation an arguable defense which I should now put in writing to them or continue to ignore?

    That's about right - three more letters with the last one offering you a discount to pay. Then silence.
  • Right now you don't need an arguable defence, as you are not (yet) being taken to court. However you DO need to acknowledge the LBA, which almost certainly fails as such in many respects.

    I've now received a reply to my LBA with the same LBA as before just with a "further information" sheet attached to it.

    Your confusion is understandable - PE has changed tack, though the general advice is pretty much the same.

    First question - did you reply to the first LBA, acknowledging it and asking for further information?

    If so, this Letter Before County Court Claim is their watered down version of the aggressive Template Letter that they were previously sending out, and you just need to carry on with the process.

    If you haven't yet replied to the first LBA, then this is their (somewhat pathetic) attempt to serve something that they can claim is compliant with the PD - even though nothing could be further from the truth!

    I replied to the original LBA as per the guidance in your thread and they've subsequently sent this LBCCC, but it looks exactly like the LBA and as I have shown has this extra sheet which looks like it's trying to address the requests in my response.

    Seen these letters before. Just search the forum for the acronym 'LBCCC' and you can read other very recent threads like yours. Needs another response as you will read on the other threads like your own.

    Just an update for everyone, my reply to the LBCCC (1st week of September) has gone unanswered and I haven't received any correspondence from them since.
  • I would also write to the Landowner who employed these clowns to extort money from genuine customers. Complain about how you felt to receive threats of court for the so called offence of parking for 11 minutes over their prescribed limit, let them know how much you spent on fuel and coffee etc, provide receipts or redacted bank statements to show this and tell them that despite of your efforts to communicate this to their Parking agent your letters have gone unanswered for weeks.

    I am sure you will think twice about using this complex in future and inform all your friends / family of this issue so they are not subject to the same incompetence and hassle for something so petty.
